1. About This Store

This store is operated by Sandy Coburn Photography & Communications, an eenmanszaak registered in the Netherlands (KVK registered, operational base: Humanity Hub, Fluwelen Burgwal 58, 2511 CJ Den Haag). References to "Sandy Coburn Photography", "we", "us", or "our" in these terms refer to Sandy Coburn Photography & Communications.

This store sells limited-edition fine art photography prints only. All prints are made to order. Consulting, communications, and other professional services offered by Sandy Coburn Photography & Communications are conducted under separate agreements and are not governed by these Terms of Service.

These Terms of Service govern your use of this website and any purchase made through it. By placing an order, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract.

2. Products

All works offered through this store are original fine art photography by Sandy Coburn, produced as strictly limited editions of fifteen (15) prints per size. Each print is made to order, assigned a unique edition number, and accompanied by a signed Certificate of Authenticity.

Product descriptions, dimensions, and images on this site are provided in good faith and are as accurate as reasonably possible. However:

• Colours displayed on screen may differ from the finished print due to variations in monitor calibration, display technology, and ambient lighting. The printed work is the definitive version of the artwork.
• Dimensions are approximate and may vary slightly based on the natural aspect ratio of each image and the chosen medium.
• Framing, matting, and presentation options are subject to material availability. Sandy Coburn Photography will notify you of any significant change before production commences.

3. Pricing and Payment

All prices are listed in Euro (EUR) with USD displayed as a secondary reference currency, automatically converted at checkout based on current exchange rates. The EUR price is the definitive price. Final totals may vary slightly based on real-time exchange rates at the time of payment.

Prices are subject to change without notice. The price applicable to your order is the price confirmed at the time of purchase. Prices may increase as editions approach sell-out; this escalation policy does not apply retroactively to orders already placed.

Payment is processed securely via Stripe, PayPal, or Wise. Sandy Coburn Photography does not store payment card details. All transactions are subject to the terms of the relevant payment processor.

Applicable taxes, duties, and import charges are the responsibility of the collector and vary by destination country. Sandy Coburn Photography will provide documentation to support customs clearance where possible but cannot be held responsible for costs imposed by the collector's local authorities.

4. Orders and Contract Formation

Placing an order through this store constitutes an offer to purchase. A binding contract is formed when Sandy Coburn Photography sends a written order confirmation and payment has been successfully processed.

Sandy Coburn Photography reserves the right to decline or cancel any order at its discretion, including in cases of pricing errors, suspected fraud, or inability to fulfil the order. In such cases, any payment received will be refunded in full.

Order confirmation emails are sent to the address provided at checkout. It is your responsibility to ensure this address is correct and that confirmation emails are not filtered as spam.

5. Production, Fulfilment, and Delivery

All prints are produced to order by Sandy Coburn Photography's fine art production partner, Whitewall, and shipped directly to the collector. Estimated production and shipping timelines are provided at the time of purchase and in your order confirmation.

Sandy Coburn Photography will notify you of any significant delay and will work to resolve it. Risk of loss and title for purchased prints passes to you upon delivery to the shipping address provided at checkout.

Shipping costs and insured delivery charges are calculated at checkout based on destination and print size. International orders are subject to local customs procedures and import regulations, which are outside Sandy Coburn Photography's control.

6. Returns, Refunds, and Cancellations

All sales are final. Returns and refunds are governed exclusively by the Returns & Refunds Policy, which forms part of these Terms of Service and should be read in conjunction with them.

In summary: no refunds are issued on made-to-order works. Damage on arrival will be remedied by replacement subject to the conditions set out in the Returns & Refunds Policy. Cancellations are accepted within 24 hours of payment confirmation only, provided production has not commenced.

7. Intellectual Property and Copyright

7.1  What you own when you purchase a print

When you purchase a limited-edition fine art print from Sandy Coburn Photography, you acquire:

• Ownership of the physical print object.
• The right to display the print privately in your home, office, or personal space.
• A signed Certificate of Authenticity documenting your edition number and provenance.
• The right to resell or gift the physical print as a private collector, provided the Certificate of Authenticity accompanies the work and the edition archive is updated by contacting Sandy Coburn Photography.

7.2  What you do not own and are not permitted to do

The following are strictly prohibited without prior written permission from Sandy Coburn Photography:

• Reproducing, copying, scanning, or photographing the print or the underlying image for any purpose other than private personal documentation.
• Publishing, sharing, or distributing the image — in whole or in part — on any platform, website, social media channel, or publication, whether for commercial or non-commercial purposes.
• Using the image in any commercial context, including advertising, product design, merchandise, editorial publication, or brand campaigns.
• Creating derivative works based on the image, including digital edits, crops, filters, or composite works.
• Displaying the print in a commercial or public setting (such as a hotel, gallery, restaurant, office lobby, or exhibition) without a separate commercial display licence. Please contact Sandy Coburn Photography to discuss licensing options for commercial display.
• Sub-licensing, assigning, or otherwise transferring any purported rights in the image to any third party.
• Removing, obscuring, or altering any watermark, signature, edition mark, or copyright notice associated with the work.

7.3  Copyright ownership

All photographs, images, artwork, text, and other content on this website and in all print editions are the exclusive intellectual property of Sandy Coburn and are protected by copyright law, including the Auteurswet (Dutch Copyright Act), the Berne Convention for the Protection of Literary and Artistic Works, and all applicable international intellectual property treaties.

Copyright in each photograph was created at the moment of capture and subsists in Sandy Coburn for the duration of her life and seventy (70) years thereafter. No act of purchase, display, or transfer of the physical print object affects this ownership in any way.

7.4  Sharing on social media

Sandy Coburn Photography appreciates collectors sharing their acquisitions on social media. If you choose to photograph your print in your space and share it online, we ask that you:

• Credit Sandy Coburn Photography and tag @sandy_coburn where possible.
• Ensure the image shared is a photograph of the print in its display context — not a reproduction of the image itself that could substitute for the original work.
• Do not crop or alter the image in a way that removes the artist's signature or edition information.

This courtesy permission for personal social sharing does not constitute a licence and does not grant any rights beyond those described above. Sandy Coburn Photography reserves the right to request removal of any image shared in a manner inconsistent with these terms.

7.5  Licensing enquiries

Sandy Coburn Photography welcomes enquiries regarding commercial display licences, editorial use, brand partnerships, and other licensing arrangements. All such use requires a separate written licence agreement. To discuss licensing, contact sandy@sandycoburnphotography.com.

7.6  Infringement

Sandy Coburn Photography actively monitors for unauthorised use of its images and will take appropriate action — including legal action — in response to infringement. If you become aware of any unauthorised use of Sandy Coburn's work, please report it to sandy@sandycoburnphotography.com.

8. Website Use

All content on this website — including photographs, text, logos, design elements, and layout — is the property of Sandy Coburn Photography & Communications and is protected by copyright. You may not reproduce, republish, scrape, or redistribute any content from this site without prior written permission.

You agree not to use this site in any way that is unlawful, harmful, or disruptive, including attempting to gain unauthorised access to any part of the site or its underlying systems.

Sandy Coburn Photography uses cookies and similar technologies in accordance with its Privacy Policy. By using this site, you consent to this use.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Sandy Coburn Photography's liability in connection with any purchase or use of this website is limited to the value of the order in question. Sandy Coburn Photography is not liable for any indirect, incidental, consequential, or special damages arising from your use of this site or any product purchased through it.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

10. Consumer Rights (EU & Netherlands)

Sandy Coburn Photography & Communications operates in accordance with applicable Dutch and European Union consumer protection law, including the Burgerlijk Wetboek (Dutch Civil Code) and EU Directive 2011/83/EU on consumer rights.

As all prints are made to order and personalised with a unique edition number through the consultation and acquisition process, they fall within the exemption to the standard 14-day right of withdrawal under EU consumer law. This is set out in full in the Returns & Refunds Policy.

Nothing in these Terms of Service affects any statutory rights you may have under applicable law that cannot be excluded or limited by contract.

11. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these terms or any purchase made through this store shall be subject to the exclusive jurisdiction of the competent courts of Den Haag, Netherlands, without prejudice to any mandatory consumer protection provisions applicable in your country of residence.

12. Changes to These Terms

Sandy Coburn Photography reserves the right to update or amend these Terms of Service at any time. The version in effect at the time of your order governs that purchase. We encourage you to review these terms periodically. Continued use of this site following any update constitutes acceptance of the revised terms.
